Terms of Service for Rivals Athletics

These Terms of service (terms ) govern your access to and participation in the services provided by Rivals Athletics, including clinics, teams, and related activities (the “Programs”). By registering for any of our Programs, you agree to these Terms. If you do not agree to these Terms, you cannot register or participate in any program offerings.

1. Eligibility and Registration

• To participate in any of Rivals Athletics’ programs, you must be at least 5 years old (grade K), and have a parent or legal guardian agree to these Terms on your behalf.

• All participants must complete the required registration forms, including personal information, medical history, and any other required documentation before registering for any clinics or teams.

• Participants must also agree to the waiver and release of liability that will be provided prior to registration.

2. Waiver and Release of Liability

• Assumption of Risk: By registering for any program, you acknowledge and accept the risks associated with recreational sports, including but not limited to injury, accidents, and property damage. You voluntarily assume all such risks.

• Waiver: By agreeing to the registration form, participants (or their legal guardians) agree to release Rivals Athletics, its officers, directors, employees, agents, coaches, team members, and volunteers from any and all liability for any injury, damage, loss, or claim arising out of participation in the Services.

3. Fees & Payment

Registration Fees: All programs, clinics, leagues, teams, camps, private training sessions, and other services offered by Rivals Athletics are subject to the registration fee displayed during the registration process.

Registration Pricing

Registration Pricing: Rivals Athletics may offer different pricing periods depending on the program, including Early Registration promotional pricing, Standard Registration pricing, and Late Registration pricing.

Early Registration pricing may be offered for a limited time and provides a discounted rate for eligible participants. Once the promotional period ends, registrations will be charged the standard program fee. Registrations received after designated deadlines may be subject to additional late registration fees.

Registration fees, promotional discounts, deadlines, and late fees vary by program and are subject to change at any time without prior notice. The applicable fee will be displayed during the registration process. Promotional pricing cannot be applied retroactively after a registration has been completed. Rivals Athletics reserves the right to modify registration pricing, discounts, registration periods, and applicable fees at its sole discretion.

Payment: Fees must be paid in full prior to participating in any event or service, unless participant is enrolled in Klarna. Rivals Athletics accepts all major credit cards and other approved payment methods.

Rivals Athletics reserves the right to cancel, combine, or modify any program due to insufficient enrollment, facility availability, weather, or other circumstances beyond its control. In such cases, participants will be offered a full refund, account credit, or transfer to another available program at the sole discretion of Rivals Athletics.

4. Cancellation & Refund Policy

Cancellation Prior to Program Start:

Participants wishing to cancel their registration prior to the start of a program must notify Rivals Athletics in writing via email to info@rivalsathletics.com.

• Cancellation requests received fourteen (14) or more calendar days before the program start date are eligible for a full refund.

• Cancellation requests received fewer than fourteen (14) calendar days before the program start date are eligible for a 70% refund of the registration fee.

• The remaining 30% is non-refundable and is retained to help offset expenses already incurred by Rivals Athletics, including but not limited to:

  • The loss of a reserved roster spot that may have otherwise been filled by another participant;

  • Program planning and administrative costs;

  • Equipment, uniforms, jerseys, apparel, awards, or other program materials purchased or ordered for the participant.

Cancellation After Program Start:

Once a program, clinic, league, camp, team, or training session has begun, all registration fees are non-refundable.

Refunds will not be issued for missed sessions, scheduling conflicts, vacations, personal commitments, or a participant's decision to discontinue participation.

Injury Related Withdrawal:

If a participant is unable to continue participating due to an injury 14 calendar days or after the program has begun, Rivals Athletics may, at its sole discretion, consider a 70% partial refund or account credit towards another program.

To be considered, the participant must submit:

• A written refund request via email to info@rivalsathletics.com; and

• A medical note from a licensed healthcare provider confirming the participant is unable to continue participating.

Any approved refund or account credit will be determined based on the number of sessions completed, the remaining sessions in the program, and expenses already incurred by Rivals Athletics. All injury related refund requests are reviewed on a case-by-case basis and are granted solely at the discretion of Rivals Athletics.

Refund Request Process:

All refund requests must be submitted in writing to info@rivalsathletics.com. Approved refunds will generally be processed within fourteen (14) business days after all required documentation has been received. Refunds will be issued to the original method of payment whenever possible. If the original payment method is unavailable, Rivals Athletics may issue the refund by check or another approved payment method.

5.  Jerseys and Equipment

• Jersey Provided: Rivals Athletics will provide each participant with a jersey as part of the registration fee.

• Participant’s Responsibility: Participants are responsible for wearing appropriate athletic clothing, footwear and proper equipment while participating in any clinics or team activities.

6. Conduct and Behavior

• Code of Conduct: Participants must behave in a sportsmanlike manner, showing respect for teammates, coaches, officials, and other participants. Rivals Athletics reserves the right to remove any participant from the program due to inappropriate behavior, including verbal or physical altercations, unsportsmanlike conduct, or non-compliance with these Terms.

• Zero Tolerance Policy: Rivals Athletics enforces a zero-tolerance policy for harassment, bullying, or discrimination in any form, and such behavior will result in immediate removal from the program with no refund.

7. Health and Safety

• Medical Clearance: Participants are required to disclose any existing medical conditions that may impact their ability to participate in the Services. Rivals Athletics strongly recommends that participants consult with a healthcare professional before engaging in any physical activity.

• Emergency Medical Treatment: In case of an emergency, Rivals Athletics may seek medical treatment for participants at their own expense. By registering, participants consent to emergency medical treatment as necessary.

8. Photo and Video Release

• Media Consent: By participating in any of Rivals Athletics’ events or programs, you consent to the use of your name, image, or likeness in photographs or videos for promotional purposes, including on the website, social media, or other marketing materials.

• Opt-out: If you do not wish to have your image or likeness used, you must notify Rivals Athletics in writing prior to participation.

9. Program Changes

• Program Modifications: Rivals Athletics reserves the right to modify or cancel any clinic, team, or event due to unforeseen circumstances such as weather conditions, low enrollment, location changes, or other factors.

10. Limitation of Liability

• No Liability for Indirect Damages: Rivals Athletics will not be liable for any indirect, incidental, special, or consequential damages arising out of participation in any Services.

• Limitation of Liability: To the fullest extent permitted by law, Rivals Athletics’ total liability for any claim related to these Terms or the Services is limited to the amount paid by the participant for the specific program or service in question.

11. Indemnification

• You agree to indemnify and hold harmless Rivals Athletics, its officers, employees, agents, team members, coaches, and affiliates from and against any claims, damages, or liabilities arising out of your participation in any Services, including those resulting from your own actions, negligence, or breach of these Terms.

12. Governing Law and Dispute Resolution

• These Terms will be governed by and construed in accordance with the laws of the state or jurisdiction in which Rivals Athletics operates. Any dispute related to these Terms or the Services will be subject to binding arbitration.

13. Privacy Policy

• At Rivals Athletics, we are committed to protecting the privacy and security of our participants and their families. Any personal information collected during registration — including names, contact information, health details, and emergency contacts — is used solely for purposes directly related to your participation in our programs, clinics, and events (“Services”).

• We do not sell, rent, or share your personal information with third parties for marketing purposes. Information may be shared only with trusted third-party service providers as needed to operate our programs (e.g., payment processing, scheduling, or emergency medical services), and only under strict confidentiality agreements.

• Photo and Video Usage

  • As part of our ongoing efforts to celebrate our community and promote our programs, Rivals Athletics reserves the right to photograph and record participants during events, practices, and games. These photos and videos may be used in promotional materials, including but not limited to our website, social media platforms, email newsletters, and printed materials.

  • If you do not wish for your child to be photographed or featured in any media produced by Rivals Athletics, you must notify us in writing by sending an email to [info@rivalsathletics. com] with your child’s full name and program details. We will make every reasonable effort to ensure that your child is excluded from any public-facing media content.

  • By registering for any Rivals Athletics program, you consent to the collection and appropriate use of your information in accordance with this policy.

14. Birthday Parties Terms & Conditions

• All birthday party inquiries and bookings are managed directly through Rivals to ensure a seamless, end-to-end experience. Rivals coordinates all aspects of the party setup, activities, and cleanup included within your selected party package.

• To confirm your reservation, a non-refundable booking fee of $250 must be paid in full. Payment of this fee constitutes acceptance of these terms and serves as an electronic agreement between the customer and Rivals. Party dates are not secured until payment has been received.

• Rivals partners with an independent, third-party vendor for optional add-ons such as balloon décor, centerpieces, customized favors, and other enhancements. This vendor is not employed by or affiliated with Rivals, and any arrangements or payments for these additional services will be handled directly between the customer and the vendor.

• Rivals is not responsible for the performance, delivery, or quality of any services provided by third-party vendors.

• Outside Food & Allergy:

  • Customers may not bring outside food or beverages into Rivals for birthday parties unless their party package specifically allows store-bought, nut-free items. Any exceptions must be pre-approved by Rivals management prior to the event.

  • Rivals is not responsible for any allergic reactions or food sensitivities related to outside food or beverages brought in by the customer or their guests. It is the responsibility of the party host and attendees to ensure that all food items are safe for their individual dietary and allergy needs.

15. Sponsorships

• Rivals offers a variety of Sponsorship Packages designed to connect local businesses and community partners with our programs, athletes, and families. Sponsors can choose from three exclusive levels: Club, Elite, or VIP.

• By purchasing a sponsorship package, the sponsor acknowledges and agrees to the terms and conditions outlined herein. The purchase serves as an electronic agreement between the sponsor and Rivals; no separate signed contract is required.

• Sponsorships are activated once full payment is received. All sponsorship benefits are non-transferable and valid only for the duration specified in the selected package description. Rivals reserves the right to adjust sponsorship offerings, placements, or materials as needed to maintain brand consistency and program quality.

16. Amendments

• Rivals Athletics reserves the right to amend or update these Terms at any time. Any changes will be posted on the Rivals Athletics website, and the updated Terms will take effect immediately upon posting. It is your responsibility to review these Terms periodically for any updates.
